By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the Service.
1. Definitions
- "Service" refers to the Know Someone website, mobile applications, and all related services.
- "User" refers to any individual who accesses or uses the Service.
- "Referrer" refers to a User who submits referrals for job opportunities.
- "Candidate" refers to an individual who is referred for a job opportunity.
- "Employer" refers to a company or organisation that posts job opportunities on the Service.
- "Reward" refers to the monetary compensation paid for successful referrals.
2. Eligibility
To use our Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
3. Account Registration
3.1 Account Creation
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorised use
3.2 Account Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Providing false or misleading information
- Any conduct that we determine is harmful to other Users or our business
4. Referral Programme
4.1 Making Referrals
When making referrals, you represent and warrant that:
- You have a genuine professional or personal relationship with the Candidate
- The Candidate has consented to being referred
- All information provided about the Candidate is accurate and complete
- You are not the same person as the Candidate (unless applying for yourself)
4.2 Self-Referrals
You may apply for jobs yourself and receive the Reward if you are hired. The same terms and conditions apply to self-referrals.
4.3 Prohibited Referral Practices
You agree not to:
- Submit fraudulent or fictitious referrals
- Refer Candidates without their knowledge or consent
- Manipulate or game the referral system
- Create multiple accounts to exploit the referral programme
- Share confidential job information outside the platform
5. Rewards
5.1 Eligibility for Rewards
Rewards are earned when:
- Your referral results in a successful hire
- The hired Candidate completes the qualifying period (typically 90 days)
- All terms and conditions of the specific job posting are met
- No fraudulent activity is associated with the referral
5.2 Reward Amounts
Reward amounts are set by Employers and displayed on each job posting. We do not guarantee any specific Reward amount and Employers may modify Rewards at their discretion for future referrals.
5.3 Payment of Rewards
- Rewards are processed after the qualifying period is confirmed
- Payments are made to your designated bank account
- You are responsible for any applicable taxes on Rewards received
- Minimum withdrawal thresholds may apply
5.4 Forfeiture of Rewards
Rewards may be forfeited if:
- The referral is found to be fraudulent
- You violated these Terms in connection with the referral
- The Candidate's employment is terminated for cause during the qualifying period
- The Employer disputes the validity of the referral
6. Intellectual Property
6.1 Our Intellectual Property
The Service, including its original content, features, and functionality, is owned by Know Someone Limited and is protected by copyright, trademark, and other intellectual property laws.
6.2 User Content
You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display such content in connection with operating the Service.
7. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Attempt to gain unauthorised access to any part of the Service
- Use automated means to access the Service without permission
- Transmit viruses, malware, or other harmful code
- Harvest or collect User information without consent
- Engage in any discriminatory practices
8. Disclaimers
8.1 Service Availability
The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, secure, or error-free.
8.2 Employment Outcomes
We do not guarantee:
- That any referral will result in employment
- The accuracy of job postings or Employer information
- The conduct or reliability of Employers or Candidates
- Any specific financial outcomes from using the Service
9. Limitation of Liability
To the maximum extent permitted by law, Know Someone Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount of Rewards paid to you in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Know Someone Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Service
11. Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
11.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Know Someone Limited regarding the Service.
